1. About this disclaimer
This Disclaimer governs your use of wenuru, the platform owned and operated by BOOKMYSET TECHNOLOGIES PRIVATE LIMITED — the website at wenuru.com, the wenuru Android application, the wenuru iOS application, and every related service, page, listing, blog post, email and communication (together, the "Platform").
In this Disclaimer, "wenuru", "we", "us" and "our" mean BOOKMYSET TECHNOLOGIES PRIVATE LIMITED.
It forms part of, and should be read together with, our Terms & Conditions, our Privacy Policy and our Cancellation Policy. By using the Platform you accept this Disclaimer. If you do not accept it, do not use the Platform.
Nothing in this Disclaimer excludes or limits any liability or right that cannot lawfully be excluded or limited.
2. wenuru is a marketplace, not a provider
wenuru operates an online marketplace that connects people looking for creative spaces and creative services with the hosts, studio owners and freelancers who offer them.
We are an intermediary. We are not the provider. wenuru:
- does not own, lease, operate, manage, control, inspect or supervise any space listed on the Platform
- does not provide photography, videography, podcast production, editing, styling or any other creative service itself
- does not employ, engage, direct, train or supervise any host, studio owner, freelancer, manager, crew member or contractor
- is not a party to the contract between a customer and a host — that contract is formed directly between them
- makes no representation and gives no guarantee about the existence, ownership, condition, cleanliness, size, capacity, equipment, acoustics, lighting, accessibility, safety, legality, licensing, insurance, quality or suitability of any listed space or service
- makes no representation and gives no guarantee about the identity, credentials, skill, professionalism, punctuality, solvency, conduct or reliability of any user
wenuru acts as an "intermediary" within the meaning of the Information Technology Act, 2000 and the rules made under it, and as a limited collection and payment agent for hosts for the purpose of collecting booking amounts through the Platform.
Any decision to book a space, engage a freelancer, accept a booking, or enter into any arrangement with another user is yours alone, made at your own risk and on your own assessment. We strongly recommend that you inspect a space or arrange a recce, confirm what is included, read the house rules, check the cancellation policy, and satisfy yourself about permissions and safety before you commit.
3. Listing information is supplied by hosts
Every listing on the Platform — its title, description, photographs, floor area, ceiling height, capacity, equipment list, amenities, power availability, parking, access instructions, house rules, operating hours, availability and pricing — is created and controlled by the host, not by wenuru.
We do not independently verify the accuracy, completeness or currency of listing information. Listings may contain errors, omissions, outdated details or subjective claims. A space may have changed since it was photographed or described. Equipment listed may be unavailable, in use, or in a different condition than expected on the day.
Where you find a listing to be inaccurate or misleading, please report it to support@wenuru.com.
4. What a "verified" badge means — and does not mean
A verified badge on a host or a listing means only that wenuru received and reviewed the identity or business documents we asked that host to submit, and found them facially in order at the time of review.
A verified badge is not:
- a certification of the quality, condition or standard of the space
- an inspection, safety audit, fire audit, electrical audit or structural certification
- confirmation that the host holds every municipal permission, licence, no-objection certificate, occupancy approval or commercial-use permission required
- confirmation that the host carries public liability, equipment or property insurance
- confirmation of the host's tax registration or compliance
- a guarantee that the host will honour a booking or perform to your expectations
- an endorsement, recommendation or warranty by wenuru of any kind
Verification is a fraud-reduction measure. It does not transfer any host obligation to wenuru, and it does not reduce your own responsibility to satisfy yourself about a space before you use it.
5. Photographs, media and visual representations
Photographs, videos, virtual tours, floor plans and other media are supplied by hosts and are illustrative only. Lens choice, focal length, lighting, staging, editing and post-processing can make a space look larger, brighter, cleaner or differently coloured than it is in person. Furniture, props, backdrops, equipment and set dressing shown in an image may not be included in your booking.
Images published on the Platform may carry the wenuru watermark. A watermark indicates only that the image was published through the Platform. It is not a claim of ownership of the space, and it is not a warranty about what the image shows.
6. Pricing, availability, quotes and taxes
Prices, discounts, add-ons, fees and availability are set by hosts and can change at any time before a booking is confirmed. Availability shown on the Platform depends on hosts keeping their calendars current, and we do not guarantee that a slot shown as available remains so.
The quote you see at checkout is the authoritative statement of what you pay through the Platform for that booking. Prices displayed elsewhere — in search results, on marketing pages, in blog posts, in emails or on social media — are indicative, may be out of date, may exclude fees or taxes, and do not constitute an offer.
Any figure we publish about typical rates, market prices, cost ranges, host earnings, occupancy or demand is an estimate for general information only. It is not a quotation, a valuation, a projection or a promise, and actual amounts will differ.
Tax treatment depends on your circumstances and on the host's registration status. We are not your tax adviser. You are responsible for your own tax position, and hosts are responsible for their own GST, income tax and invoicing obligations.
7. Reviews, ratings and rankings
Reviews are written by users and express their own opinions and experiences, not those of wenuru. We do not endorse, adopt or verify the factual accuracy of any review.
Ratings, review counts, badges, "featured", "popular", "trending" and similar labels, and the order in which listings appear in search, are generated automatically from platform data and settings. They may be influenced by relevance, recency, completeness of a listing, host responsiveness, booking volume, subscription tier and other operational factors. They are not an endorsement, a certification or a quality guarantee, and they should not be read as advice.
A high rating does not guarantee a good experience, and a low rating does not mean a space is unsuitable for you. Read individual reviews, and form your own view.
8. Freelancers and creative service providers
Freelancers listed on the Platform are independent professionals. They are not employees, agents, partners or representatives of wenuru. We do not verify their portfolios, credentials, qualifications, equipment, insurance or business registrations beyond the documentary checks described in Section 4.
wenuru gives no warranty as to the quality, originality, timeliness, licensing or commercial fitness of any work a freelancer produces, and is not responsible for any dispute over deliverables, revisions, usage rights, copyright, credit or payment terms agreed directly between you and a freelancer. Agree scope, deliverables, timelines, usage rights and fees in writing before work begins.
9. Safety, premises and equipment
You use a booked space at your own risk. wenuru does not inspect premises and does not certify that any space, its electricals, rigging, flooring, stairs, lifts, ventilation, exits, fire equipment, furniture or production equipment is safe or fit for your intended use.
You are responsible for:
- assessing the space for your intended activity, including any activity involving heights, rigging, water, heat, flame, pyrotechnics, animals, vehicles, minors, stunts or heavy equipment
- the safety and conduct of everyone you bring, including crew, talent, clients and guests
- your own equipment, media, footage, data and belongings — neither wenuru nor, in the absence of its own negligence, the host is responsible for their loss, theft or damage
- obtaining your own insurance, including public liability and equipment cover, appropriate to your production
- obtaining every permission, licence, release and consent your production needs, including consents from identifiable people, location permissions, and music and other third-party licences
wenuru is not liable for any personal injury, illness, death, property damage, equipment failure, power outage, water or internet failure, noise complaint, eviction, police or municipal action, or loss of production time arising from your use of a space.
10. Content moderation and automated systems
The Platform uses automated systems to help keep the marketplace safe, including automated masking of contact details and off-platform payment requests in messages, automated scanning of uploaded images and files, and automated watermarking. These systems are described in our Privacy Policy.
Automated systems are imperfect. They may produce false positives, masking or blocking legitimate content, and false negatives, failing to catch content that breaches our rules. wenuru gives no warranty that every prohibited item will be detected or that no legitimate item will be affected, and is not liable for loss arising from either outcome, including a message that was masked, an attachment that was blocked or delayed, or content that was not caught.
Similarly, we do not pre-screen all user content. Content on the Platform may be inaccurate, offensive or unlawful notwithstanding our efforts. Report it to support@wenuru.com.
11. Maps, addresses and location data
Maps, place names, addresses, pin locations, coordinates, distances, travel times and "nearby" results are generated using third-party mapping and places services and data supplied by hosts. They are approximate and provided for convenience only.
Do not rely on them for navigation-critical, access-critical or time-critical decisions. A pin may be offset, an address may be incomplete, and access to a building may be through a different entrance. Confirm exact directions, parking, loading access and lift availability with the host before you travel.
12. Third-party services, links and payments
The Platform integrates and links to third-party services, including payment processing, cloud hosting and storage, image analysis, mapping and places data, sign-in providers, analytics, email delivery, embedded video, and links published by users or in editorial content.
wenuru does not control these services and gives no warranty about their availability, accuracy, security, content, pricing or practices. A link or an integration is not an endorsement. Your use of a third-party service is governed by that provider's own terms and privacy policy, and any dispute about it is between you and that provider.
Payments are processed by Razorpay, an independent payment aggregator authorised by the Reserve Bank of India. wenuru does not collect or store your card, UPI or net-banking credentials, and is not responsible for a failure, delay, decline, duplicate charge or outage in the payment network, the issuing bank or the gateway. Refund timelines after we initiate a refund are set by the bank and the gateway, not by us.
13. Editorial, blog and informational content
Articles, guides, checklists, city pages, comparisons, cost estimates and other editorial content on the Platform are published for general information only. They are not professional, legal, financial, tax, insurance, safety, technical or business advice, and they do not take account of your particular circumstances.
Content may be prepared at a point in time and may become outdated. Prices, rules, availability, regulations and best practice change. We make reasonable efforts to be accurate but give no warranty of accuracy, completeness, currency or fitness for any purpose.
Do not act, or refrain from acting, on the basis of anything you read here without taking appropriate professional advice. wenuru accepts no liability for any decision taken, cost incurred or loss suffered in reliance on our editorial content.
14. Statements about host earnings and outcomes
Any statement on the Platform about what a host could earn, how quickly a space might get booked, expected occupancy, demand in a city, or the commercial benefit of listing, is an illustration based on general or historical platform data. It is not a forecast, a projection, a target or a guarantee.
Actual results depend on factors outside our control, including the space itself, its location, pricing, photography, responsiveness, seasonality, competition and market conditions. Many hosts earn less than any figure illustrated, and some earn nothing. Past performance is not indicative of future results.
15. Availability of the Platform
The Platform is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components, or that any defect will be corrected.
We may modify, suspend, limit or discontinue any feature, listing, page or the whole Platform at any time, with or without notice. Features may differ between the website, the Android app and the iOS app, and between versions. Scheduled and unscheduled maintenance, third-party outages, network failures and force-majeure events may make the Platform unavailable, and we are not liable for loss arising from unavailability.
16. Mobile applications
The wenuru Android and iOS apps are provided subject to our Terms & Conditions.
Apple Inc. and Google LLC are not affiliated with, do not sponsor and do not endorse wenuru. They provide no warranty in respect of the apps, have no obligation to furnish maintenance or support, and are not responsible for any claim relating to the apps, including product liability, legal compliance or intellectual-property claims. Any such claim is a matter between you and wenuru.
App behaviour depends on your device, its operating system version, its permissions and your network. We do not warrant that the apps will function on every device or configuration, and features that depend on a device permission you have declined will not work. Store listings, download availability, crash reporting and update delivery are controlled by Google Play and the Apple App Store, not by us.
17. Errors, omissions and changes
The Platform may contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, availability, offers or editorial content. We reserve the right to correct any error and to cancel or refuse any booking arising from a manifest pricing or description error, including after a booking has been submitted, and to refund amounts paid for it. We are not obliged to honour a manifestly erroneous price.
18. No advice and no fiduciary relationship
Nothing on the Platform, and nothing said by our support or sales team, constitutes legal, tax, accounting, insurance, safety, engineering, investment or other professional advice, or creates a fiduciary, advisory or confidential relationship between you and wenuru. Seek independent professional advice appropriate to your circumstances.
19. Limitation of liability
To the fullest extent permitted by law, wenuru, its affiliates and their respective directors, officers, employees, agents and licensors will not be liable for any loss or damage — direct, indirect, incidental, special, consequential, exemplary or punitive — arising out of or in connection with the Platform, any listing, any booking, any user, any third-party service, or any reliance on any information published on the Platform.
The limitations and caps set out in Section 18 of our Terms & Conditions apply to this Disclaimer and are incorporated into it, including the cap on our total aggregate liability.
Nothing in this Disclaimer excludes or limits liability for death or personal injury caused by our own negligence, for our own fraud or wilful misconduct, or any other liability that cannot lawfully be excluded.
20. Changes to this disclaimer
We may update this Disclaimer at any time. The "Last updated" date at the top of this page shows the current version. Continued use of the Platform after a change takes effect means you accept the updated Disclaimer.
